Terms of Service

These terms are an agreement between you and Company legal name, address ("we", "us") for Supersaas Analytics, the hosted web analytics service at this website ("the Service"), and for the Self-hosted License. By creating an account or buying a License, you accept them. If you accept them for a company, you confirm that you may bind it.

The Service is meant for businesses and professionals, not for consumers acting outside their trade.

Your account

• Keep your sign-in details safe. You are responsible for what happens under your account and in your Organizations.
• An Organization has one Owner, who manages billing and can transfer ownership. The Owner decides who else becomes a Member, and with which role.
• Give us a working email address. We use it for sign-in links and for notices about the Service.

Using the Service

You may use the Service to measure websites you own or are allowed to measure. You may not:

• send data to it that you are not allowed to collect, or personal data the tracking snippet is not designed for, such as emails or names in page paths, Event names or properties;
• use it to break the law, including privacy and consumer protection law;
• probe, overload or disrupt it, get around its limits, or access other customers' data;
• resell the hosted Service as your own without our written agreement.

You are the controller of the analytics data your websites send, and you inform your visitors about it. Our Privacy Policy describes how we process that data on your behalf, and it forms our data processing terms with you. If you need a signed data processing agreement, write to us.

Trial, Subscription and Quota

• A new Organization starts with a 7-day free Trial, with every feature and no card. Each email address and each website gets one Trial: further Organizations, or a website that has already had a Trial, need a Subscription.
• After the Trial, the Service needs a monthly or yearly Subscription. Prices are on the pricing page. A Subscription renews automatically until you cancel it, and cancelling stops the next renewal.
• If the Trial or a Subscription ends, the dashboard becomes read-only and tracking carries on for 7 more days. After that, new hits are no longer stored. Your data is kept until you delete it or we close inactive accounts with notice.
• Each Organization has a monthly Quota of 1,000,000 Pageviews, Outbound link clicks and Events across all its Sites, up to 20 Sites and up to 10 Members. The Owner is emailed at 80% and 100% of the Quota. Above 150% of it, new hits are not stored until the next month.

Payments

Polar Software, Inc. sells the Subscription and the License to you as our merchant of record, so your purchase is also subject to Polar's terms, and Polar handles invoices, taxes and refunds. Prices exclude taxes, which Polar adds where required. We may change prices for future billing periods with at least 30 days' notice by email.

Refunds are at our discretion, unless the law gives you a right to one.

Self-hosted License

A License is a one-time purchase. It gives you:

• a non-exclusive, non-transferable right to run copies of the software on infrastructure you control, for your own business and your clients' websites;
• access to the private repository, and the updates published there.

You may change the code for your own use. You may not share, sell or publish the code, your License key or access to the repository, or offer the software as a hosted service to third parties. With a License you run the software yourself: you are responsible for your infrastructure, its costs and the data in it, and we do not process any of it.

Your content and data

Your data stays yours. You give us only the rights we need to run the Service for you: to store, process and show it to the people you allow, and to send the figures your Ask AI questions and Digests need to our AI provider. You can delete Sites and Organizations, with their data, at any time.

Availability and changes

We work to keep the Service available and your data safe, but we do not promise it will be uninterrupted or error-free. We may change or remove features. If a change takes away something important you pay for, we will tell you in advance, and you may cancel.

Suspension and ending

You can stop using the Service and delete your Organizations at any time. We may suspend or close an account that breaks these terms, after a warning when the breach can be fixed, or at once when it puts the Service or others at risk. If we stop offering the Service, we will give at least 60 days' notice and refund the unused part of prepaid Subscriptions.

Liability

The Service and the software are provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits or lost data, and our total liability in any 12 months is limited to the amount you paid us in those 12 months. Nothing in these terms limits liability that cannot be limited by law, such as for fraud, or for death or injury caused by negligence.

General

• We may update these terms. We will post the new version here, update the date above, and email Owners about important changes at least 30 days before they apply. Using the Service after that means you accept them.
• These terms are governed by the laws of jurisdiction, and its courts have jurisdiction, unless the law where you are based says otherwise.
• If part of these terms is invalid, the rest still applies.
